What Is Premises Liability?

A premises liability claim is a claim that arises as a result of some dangerous condition on a property that you might be present on. Whether that’s ice that has formed and causes someone to slip, or a dangerous condition caused by the stacking of boxes at a department store—anything that creates a dangerous condition that was unreasonably created can give rise to a premises liability claim, allowing you to hold someone responsible for the injuries that you suffered.

The steps involved in any premises liability case involve the same sorts of things you have for any other case. They involve, first, collecting any data, facts, documents, or evidence that may prove what happened. Secondly, you may have to file a lawsuit, which means going through the procedures that a court requires of you to properly bring a legal claim against the person or business that caused your injuries.

A premises liability case can be different from other sorts of personal injury cases. Oftentimes, the dangerous condition that was created may have been created years, weeks, or days before, as opposed to a dangerous condition on the road being created in the moments before a car crash occurs. So it’s important to investigate those types of claims to make sure you know exactly what caused your injuries in the first place—whether that was something that was done last week or last year—and then be able to prove that those actions actually caused your injuries on the day that they did.
