What Evidence Is Needed in a Medical Malpractice Claim?

The most important piece of evidence in any medical malpractice case is testimony from an expert witness.

Any medical malpractice case needs an expert doctor, hospital specialist, or a nurse, someone else who specializes in that field to testify as to what we call the standard of care is the standard of care is simply what a reasonable physician, nurse, or hospital would do under the same or similar circumstances.

And in order to prosecute any medical malpractice case, we as lawyers need to have that testimony from an expert, and it’s simply the most important piece of evidence there is in any medical malpractice case.
